The Right to Affordable Justice: The Bach Commission

On 22nd September 2017 the Bach Commission, setup by Leicestershire Police and Crime Commissioner and former barrister Lord William Bach, issued its final report in relation to cuts in legal aid.

After consultations and deliberations extending over 2 years the report confirms the commission’s finding that cuts in legal aid have created a system whereby those unable to pay for representation or advice go without.

The report has suggested that a Right to Justice Act in order to ensure a minimum standard is maintained in relation to access to justice. This new Act is designed to reaffirm the right to justice and establish a new right for individuals to have access to affordable legal assistance. The Act will also set up the Justice Commission in order to ensure compliance with this new right. Further to this the Commission also set out an immediate action plan for the government to ensure access to justice in widening the availability of legal aid and amending the eligibility requirements.
