The week commencing the 10th November 2025 has been designated Good Divorce Week by Resolution, an organisation comprising family lawyers committed to resolving family law matters as amicably as possible. Whilst not all of our Family Solicitors are members of Resolution, all adhere to its ideals and objectives, so it is worth considering how this can help a client.
What are the current issues facing the Courts?
The Family Courts are overwhelmed, with significant and severe delays likely to affect most cases. According to latest statistics, on average over 1,000 new cases start in the Family Courts each working day. To alleviate the pressures and demands on the court service the President of the Family Division encourages lawyers to consider alternatives to court, called NCDR or Non-Court Dispute Resolution options, and made them a mandatory requirement in most cases. This could include mediation, but also arbitration, private FDRs or the collaborative process. All these options mean cases are kept out of court, minimise conflict, save money and avoid delay.
What sets Resolution Members apart?
Resolution members subscribe to a Code of Practice, which promotes non-confrontational, constructive approaches to reaching agreements, which necessarily involves avoiding Court proceedings where possible. Resolution members will promote communication and focus on long-term wellbeing for the family as a whole. This can produce quicker, better tailored outcomes which suit your individual needs and requirements.
The widespread adoption of the Code, and its endorsement by the Courts, have fundamentally shifted the way Family Law is practised. Campaigning by Resolution has brought about changes in the law, most notably the change to No-Fault Divorces, whereby blame for the breakdown of the marriage no longer has to be fought through the Courts.
