With offences ranging from failing to wear a seatbelt to causing death by dangerous driving it is arguable that no other area of criminal law covers such a broad spectrum of offending behaviour.

At Emery Johnson Astills our specialist road traffic lawyers have the extensive experience to advise and represent in relation to any driving offence.

The most common driving offences are as follows:

  • Death by dangerous driving
  • Dangerous driving
  • Death by careless driving
  • Driving without due care and attention
  • Excess alcohol/drugs
  • Failing to stop/report an accident
  • Driving whilst disqualified
  • Using a mobile phone whilst driving
  • Driving without insurance
  • Driving without a licence
  • Speeding
  • Traffic signal offences
  • No MOT certificate
  • Failing to provide driver details
  • Seatbelt offences

A driving licence is something many take for granted but the loss of it can have a devastating impact on you, your family and friends with the loss of earnings, restrictions on getting around, and even the loss of liberty if handed a prison sentence in the most serious of cases. At Emery Johnson Astills we understand how essential a driving licence can be to get to work, to run a business, to do the school run, and to visit friends and family.

Penalty points are cumulative and remain on a licence for three years. Under probationary requirements new drivers are banned if they receive 6 points within the first 2 years of having a full licence. Beyond the 2 year probationary period automatic disqualification as a ‘totter’ applies if 12 or more points are accrued in a three year period. Reaching 12 points however does not always mean that disqualification will follow. At Emery Johnson Astills we can advise on the possibilities of making an application to the Court in order to help you keep your licence.

If you find yourself facing any motoring offence it is vital to contact a solicitor as soon as possible to establish whether legal aid is available for your case. Alternatively for offences which do not qualify for legal aid we offer fixed fees for appointments and representation.
