Caught Speeding - What are the consequences?

Leicestershire saw almost twice as many speeding prosecutions in 2022 compared to 2021, reports show.

Nationally, the number of drivers receiving a speeding conviction has reached an eight-year high. Most people caught speeding were offered a fine and either penalty points or to participate in a speed awareness course. However, some drivers maybe disqualified because of the excessive speed or previous penalty points.

With the increase of speeding prosecutions, it is likely that more drivers will find themselves with increasing penalty points. If you find yourself with 12 or more points you risk an automatic disqualification.

Can I avoid a disqualification?

If you find yourself due to appear before the Court for a speeding offence and already have 6 or more penalty points on your licence, it is important you understand the Court could disqualify you from driving.

The only way of avoiding a disqualification following a conviction for speeding, is to argue exceptional hardship. To be successful in an application for exceptional hardship you will have to demonstrate to the Courts that it would cause significant hardship to you, and more importantly to others, if you were to be disqualified from driving.

How long could I be banned?

The mandatory minimum driving ban for ‘totting up’ is 6 months, however if you have previously been banned from driving this could increase the length of the ban to 12 or even 24 months.
