What is the current divorce process in the UK?

There are 4 main stages to the divorce process:

  1. The application – made either solely or jointly with your spouse.
  2. The acknowledgement of service form completed by the Respondent (this does not apply if the application is made jointly).
  3. The Conditional Order.
  4. The Final Order.

What are the criteria to get divorced?

  • You must have been married to your spouse for at least 12 months.
  • Your marriage must be legally recognised in the UK.
  • You must confirm that the marriage has irretrievably broken down.

How long does the divorce procedure take?

The divorce procedure takes a minimum of 6 months. There is a 20-week reflection period where the court encourages parties to discuss the practical arrangements, such as financial and child arrangements. Do I need to blame my spouse for the breakdown of the marriage?

The divorce procedure is now on a no-fault basis. This means that there is no need to prove fault or assign blame, which makes the process less contentious and encourages a more amicable approach to your separation.
